Woman, 83, breaks nose at Long Island Apple store, sues for $1M

Apple’s retail stores are too modern for some of its customers, according to a lawsuit filed by an 83-year-old New York resident. Evelyn Paswall is suing Apple for $1 million after breaking her nose by walking into the nearly transparent glass door at Apple’s Manhasset, Long Island store.

According to the report, she walked into the door on the way into the store with an iPhone issue. Her attorney, Derek T. Smith said,

“Apple wants to be cool and modern and have the type of architecture that would appeal to the tech crowd. But on the other hand, they have to appreciate the danger that this high-tech modern architecture poses to some people.

“There were no markings on the glass or they were inadequate. My client is an octogenarian. She sees well, but she did not see any glass.”

The lawsuit accuses Apple of negligence for not elderly-proofing the store’s see-through facade. It’s true that Apple wants an untra-cool facade, but it’s been recommended for years that parents put stickers or something on glass patio doors so that their children can see the door, and not run through them. Granted, not the same situation exactly, but still …

According to a report, Paswall, a former Manhattan fur-company vice president, still drives, so her vision would seem to be “in the clear.”

It was noted that there are small white warning strips visible on the glass at the Apple store in question. It’s unclear, though, if they were in place before Paswall’s accident.
